Once a rental agreement has been signed , failure to allow the tenant to move in would be a breach of contract and could open you up to a lawsuit/claim by the tenant for moving and related expenses as well as legal fees (our rental agreements have a $1,000 maximum legal fees clause) In addition, you might be held liable for the term of the lease for any extra rent they had to pay if their new equivalent unit had a higher rent If you insist on us not letting a tenant move in we will follow your directions but depending on the reasons we may no longer be able to continue to manage the property and we would have to return immediately to the tenant any security deposit and rent paid and their rental application fees. |
